Attention all Waste Transporters who operate within the State of New York: The NYSDEC Part 364 regulations governing Waste Transporters went into effect on May 3, 2018.

 

The purpose of Part 364 is to guard against environmental impacts that result from mishandling and mismanagement of regulated wastes being transported from the site where the waste is generated to the ultimate treatment, storage or disposal facility.  By regulating waste transportation under Part 364, NYSDEC seeks to prevent waste discharges into the environment, whether the releases are accidental or intentional, except at a site approved for the treatment, storage or disposal of the waste.  Note that Waste Transporters operating in New York City may be subject to additional requirements.

Part 364 pertains to transporters of many different types of wastes including, but not limited to the following: Regulated Medical Waste (RMW), Hazardous Waste, waste from commercial operations, Waste Oil, and Industrial-Commercial Waste [includes Construction and Demolition debris (C&D) generated or transported by an industrial or commercial business and Fill Material generated by commercial and industrial activities].  Refer to 6 NYCRR Part 364 for a full listing of the regulated waste types.

As of May 3, 2018, any transporter who has not made the required filings with the DEC is operating out of compliance with Part 364.

Part 364

Transporters that in the past were not required to obtain a Waste Transporter permit may now be required to do so. Also, transporters that were exempt may now need required to attain a Part 364 Waste Transporter registration a permit.

Certain transporters that transfer specific types and quantities of regulated waste may be exempt from obtaining a Waste Transporter registration or permit.  Exempt facilities may still need to comply with record keeping and reporting requirements under Part 364.
