New Pre-Determined BUD Forms Are Now Available!

A Predetermined BUD, or Beneficial Use Determination, is a determination by the New York State Department of Environmental Conservation that a material ceases to be considered a “waste” and thus can be beneficially used with fewer restrictions on handling.

Similar to the Waste Tracking Document which is required whenever a fill material waste is being transported, the new Predetermined BUD Use forms were recently created that can be provided to contractors, transporters, or local and state officials when there is a need to document the reuse of material. While the use of the Waste Tracking Document is required to satisfy the requirements of Part 361-5.6 and 364-5.1 for the transport of C&D Debris, the use of the Predetermined BUD Use forms are optional.

Among the many types of material that are classified as Pre-determined BUDs, the point at which that determination can be made can vary. For example, General Fill generated outside New York City is no longer considered a waste at the point when being used; asphalt pavement is no longer considered a waste at the point when it meets the requirements for use; and mulch is no longer considered a waste at the point when it is processed and leaves a solid waste management facility for use as mulch and other common uses.
