The New York State Department of Environmental Conservation published the new Part 360 Regulations on September 20, 2017. You can read it here:
If you are the owner of a Solid Waste Facility, the changes to NYS DEC new Part 360 rule will affect you. Important dates to know include:
- Published Date: September 20, 2017
- Effective Date: November 4, 2017
- Full Compliance with the Rule by: May 3, 2018 (180 days)
Significant Changes
The new Part 360 rule changes will require most existing fill material transfer stations to obtain a New York State Permit. If you own or operate a fill material transfer station that handles over 500 tons/day, you will need to file for this permit. The permit is an extensive process, needs to be completed by a Professional Engineer, and you need to have submitted for the permit within 545 days of the effective date. However, each facility needs to be in compliance with the rule within 180 days of the effective date. If you have not filed for the Permit within the 545 days, the facility can be at risk for substantial daily fines or closure.
If your facility does not handle more than 500 tons/day on a weekly average, then you can maintain a registered facility. You will have to file for a new registration within 545 days of the effective date.
