Any facility storing, using or handling hazardous substances in New York City is required to complete an annual Community Right-to-Know Program (RTK), filing with the NYC Department of Environmental Protection, NYC Fire Department, and/or New York State Emergency Response Commission. This rule applies to facilities of all sizes ranging from chemical plants
and power generating stations to smaller businesses, such as automotive service garages and nursing homes. These filings are due annually by March 1st. Failure to complete the filing or doing so incorrectly can result in fines up to $2,500. Walden can ensure that your RTK filing is completed on-time by providing you with the following services:
On-site Facility Inspection
Our trained professionals will give your business the careful attention to detail expected from a NYCDEP inspector and identify potential environmental violations around the workplace.
Inventory Hazardous Substances
Sometimes it is not always clear which of the substances your business uses are considered “hazardous” by regulatory agencies. An updated and organized chemical inventory is a necessity for Tier II Filing, and Walden will deploy our Right-to-Know experts to catalog your chemicals for NYCDEP reporting.
Calculate Hazardous Substance Quantities
The NYCDEP limits the amounts of certain chemicals that can be stored at your facility before it is considered reportable. These limits, however, are chemical specific. Walden’s staff will evaluate your chemical’s ingredients and do the math for you.
Compile Safety Data Sheets
Safety Data Sheets hold important information about a chemical’s properties and are required to be accessible to employees. Walden can create a package of Safety Data Sheets for your facility based on the chemicals inventoried.
Fill Out All Necessary Paperwork
Walden will complete all paperwork required for the NYCDEP, FDNY and/or New York State Emergency Response Commission filings, including Facility Inventory Forms (FIF). We will send you a complete package with your chemical inventory ready for submission to the various regulatory agencies.
Complete Online Filing Submittal for NYCDEP
Tier II filing on the NYCDEP’s website can be a daunting process. Let Walden’s team help you by handling your business’s web based Right to Know needs, including Safety Data Sheet uploads and data inventory submissions.
Aid Facilities with Late Submissions
We know that business owners have a million things to do, and the Right to Know Filing might not be at the top of your list. If compliance with RTK fell off your radar, and you find yourself past the due date, Walden can help ensure your information is submitted correctly and quickly, to avoid fines associated with noncompliance.
Violation Response Assistance
Did your business receive a fine from the NYCDEP? The fines grow for repeat offenses. Walden’s professionals can help guide you back into regulatory compliance.
